Visas for Individuals with Extraordinary Talent in Science, Art, Education, Business or Athletics |

Generally, United States’ immigration law encourages very talented or highly-educated foreign nationals to travel to the U.S. and utilize their skills within its borders. One way it does so is by providing temporary visas, known as “O” visas, to foreign nationals who have extraordinary ability in science, art, education, business, or athletics. For example, the “O-1” visa category allows an individual with a well established record of extraordinary achievement as an artist, actor, chef, lecturer, athlete, architect or other career to enter the U.S. and work in his or her field. The “O-1” category also covers those with a demonstrated record of achievement in the motion picture or television industry. |

Temporary Visas for Athletes and Performing Artists |

Under U.S. immigration law, athletes and performing artists are eligible for temporary, non-immigrant visas known as “P-visas.” The P-visa category is broken down into four groups, (1) internationally recognized athletes (“P-1A”); (2) internationally recognized entertainers (“P-1B”); (3) artists and entertainers entering the United States through a reciprocal exchange program (“P-2”); and (4) artists and entertainers involved in performing, teaching, or coaching a culturally unique program (“P-3”). The law also provides temporary, non-immigrant visas to the spouses and children of P-visa holders (“P-4”). All P-visa holders must enter the United States to participate in a specific event, performance, or program. |

Permanent Green Card for Persons of Extraordinary Ability |

Persons with "extraordinary ability" in the sciences, arts, education, business, or athletics may obtain a permanent residence (Green Card) through the First Preference Employment-Based Category (EB-1). Extraordinary ability is defined as a level of expertise indicating that the applicant is one of that small percentage who has risen to the very top of the field of endeavor. Applicants are exempt from applying for the labor certification from the Department of Labor. |
